In what cases are public procurement carried out using a special procedure?

Fire safety requirements in the design and construction of buildings and structures are established in the technical regulations "General requirements for fire safety" (approved by the Order of the Ministry of Emergency Situations of 17.08.2021 No. 405, hereinafter referred to as the Technical Regulations). According to paragraph 17 of the Technical Regulations, personal respiratory and visual protection equipment (self-rescuers) are provided to people in the premises of buildings of functional fire hazard subclasses F1.2, F1.5 and F4.3 located at a height of more than 28 m. At the same time, in accordance with paragraph 18 of the Technical Regulations, individual and collective means of rescue are provided for buildings of functional fire hazard subclasses F1.2 and F1.5 with a height of more than 50 m. It follows from the above that buildings not listed in paragraphs 17 and 18 of the Technical Regulations are not subject to the provision of personal respiratory and visual protection equipment (self-rescuers), as well as individual and collective means of rescue.

The number of hours and the validity period of the certificate are established by the Rules of training, retraining and testing of knowledge of specialists, workers in the field of industrial safety, approved by Order of the Minister of Emergency Situations of the Republic of Kazakhstan dated July 9, 2021 No. 332.

According to the resolution of the Government of the Republic of Kazakhstan dated December 19, 2014 No. 1358, compensation for damage (damage) caused to victims as a result of natural emergencies is carried out at the expense of the budget funds of the local executive body provided for the elimination of the consequences of natural emergencies, voluntary contributions from citizens, foundations and public associations, and other sources. At the same time, the victims who have suffered material damage, within thirty calendar days from the date of occurrence of the emergency, submit to the local executive body an application for compensation for material damage. The application for compensation for the damage caused is accompanied by: 1) a copy of the identity document of the injured person; 2) a list of the lost and / or damaged property of the victim from the moment of occurrence of a natural emergency or during the liquidation of an emergency. The application for compensation of material damage is considered by a specially created commission of the akimat within fifteen working days from the date of receipt of the documents. Compensation for damage (damage) caused to individuals and legal entities by man-made emergencies is made by the causer of the damage (damage) voluntarily or by a court decision. Non-refundable: 1) temporary structures, household and other buildings that are not related to real estate objects in accordance with the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities, as well as illegally constructed objects; 2) valuable clothing, luxury items, or items made of precious metals, items of artistic value. To provide housing, in accordance with the Decree of the Government of the Republic of Kazakhstan dated November 21, 2021 No. 1222 "On Approval of the Rules for providing Housing to Citizens left without housing as a result of an Emergency", it is necessary to apply to the local executive body with the following documents in accordance with the established procedure: 1) a copy of the identity document of a citizen of the Republic of Kazakhstan. In case of loss or destruction of such a document, as a result of an emergency or during its liquidation-a copy of the temporary identity card issued by the internal affairs bodies; 1-1) an application from the owner of the immovable property (or from his representative by proxy) in the prescribed form; 2) technical passport of the real estate object (housing); 3) identification document for the land plot (act on the right of private ownership of the land plot); 4) a certificate of the absence (presence) of real estate issued by the State Corporation "Government for Citizens".

In accordance with subparagraph 4 of paragraph 2 of the Rules for the Creation and Use of Civil Defense Facilities (approved by the Decree of the Government of the Republic of Kazakhstan dated December 19, 2014 No. 1357), civil defense protective structures are created to protect the largest working shift of organizations classified under civil defense categories, as well as to protect non-transportable sick medical organizations. Along with this, according to paragraph 6.2.1 of the SP RK 2.04-101-2014 the norm of the floor area of the main room per sheltered person should be taken equal to 0.5 m2 for a two-tier and 0.4 m2 - for a three-tier arrangement of bunks. The internal volume of the room must be at least 1.5 m3 per sheltered person. When determining the need for the accumulation of civil protection equipment, it is necessary to follow the Instructions for Determining the Need for Civil Protection Equipment (approved by the Order of the Minister of Emergency Situations of the Republic of Kazakhstan No. 260 of May 29, 2014). In turn, the need for civil protection units is defined in the Rules for the Creation, Maintenance, Logistics, Training and Involvement of civil protection units (approved by Order of the Minister of Internal Affairs of the Republic of Kazakhstan No. 387 of April 23, 2015).

The inspection of personal respiratory protection equipment (filter gas masks) is regulated in accordance with the Laws of the Republic of Kazakhstan No. 61-IV of July 5, 2008 "On Accreditation in the field of conformity assessment" (hereinafter referred to as the ZRK "On Accreditation") and No. 603 of November 9, 2004 "On Technical Regulation", as well as the technical regulations of the Customs Union "On the safety of personal protective equipment" approved by the decision of the Customs Union Commission No. 878 of December 9, 2011. At the same time, this type of activity is carried out by organizations accredited in the field of laboratory testing of personal protective equipment (paragraph 5.14. of Chapter 5 of the technical regulations of the Customs Union "On the safety of personal protective equipment"). The certificate of accreditation in accordance with the ZRK "On Accreditation" is issued by the authorized body responsible for state regulation in the field of technical regulation and ensuring the uniformity of measurements. The standards of equipment of premises with portable fire extinguishers for storage facilities are specified in Table 1 of Annex 1-6 to the Fire Safety Rules approved by the Decree of the Government of the Republic of Kazakhstan dated October 9, 2014 No. 1077.

According to paragraph 1 of Appendix 1 to the Fire Safety Rules approved by the decree of the Government of the Republic of Kazakhstan dated 09.10.2014 for No. 1077, evacuation plans are developed in buildings and structures (except for residential buildings) with a single stay on the floor of more than 10 people.
