According to paragraph 8 of Article 13 of the Law of the Republic of Kazakhstan dated April 16, 1997 "On Housing Relations", the right to gratuitously receive ownership of the dwellings occupied by them from the State housing fund have:
1) disabled people and participants of the Great Patriotic War. In the event of the death of a disabled person or a participant in the Great Patriotic War, who was provided with housing, the right to receive it free of charge passes to his family members; 2) disabled people of groups 1 and 2; 3) persons who participated in the liquidation of the consequences of the Chernobyl nuclear power plant disaster, other radiation disasters and accidents at civilian or military facilities, as well as those who participated directly in nuclear tests and exercises; 4) citizens of the Republic of Kazakhstan who suffered as a result of nuclear tests at the Semipalatinsk nuclear test site; 5) military personnel who have become disabled as a result of wounds, contusions, injuries received in the defense of the former Union of Soviet Socialist Republics, while performing other duties of military service in other periods or as a result of illness associated with being at the front, as well as during military service in Afghanistan or other states in which military operations were conducted; 6) citizens of the Republic of Kazakhstan affected by an environmental disaster in the Aral Sea region; 7) military personnel, as well as employees of special state bodies who have a length of service of twenty years or more in calendar terms, with the exception of military personnel and employees dismissed for negative reasons; 7-1) family members of an employee or serviceman of a special state body who died (deceased) when serving in special state bodies, except for the case provided for by the Law of the Republic of Kazakhstan "On Special State Bodies of the Republic of Kazakhstan", family members of the serviceman, deceased (deceased) during the performance of military service in peacetime, as well as family members of an employee of the internal affairs bodies who died (deceased) when serving in the internal affairs bodies, regardless of the length of service of the deceased (deceased); 8) candidates for cosmonauts, cosmonauts. In the event of the death (death) of a candidate for cosmonauts, an astronaut who was provided with housing, the right to receive it free of charge passes to the heirs of the deceased (deceased); 9) victims of political repression, as well as persons who have suffered from political repression, rehabilitated in accordance with the Law of the Republic of Kazakhstan "On Rehabilitation of victims of mass political repression", who have disabilities or are pensioners; 10) employees of internal affairs bodies who have been dismissed from service and have a length of service of twenty or more years in calendar terms, with the exception of employees dismissed for negative reasons, as well as employees who have ten or more years of service in calendar terms and have dependent children with disabilities.
If the applicant does not belong to any of the above categories entitled to the gratuitous privatization of occupied dwellings, the applicant has the right to privatize the dwelling at the residual value under the conditions provided for by this Law and in the manner determined by the Government of the Republic of Kazakhstan.
